Formal Complaints Process

A formal complaint can be filed against a member of Equity for violating the Bylaws’ Standard of Professional Conduct by engaging in inappropriate behaviour in the workplace.

Workplaces may include rehearsals, performances, fittings, production meetings, auditions and interviews, travel and housing, and events organized by an Engager and related to an engagement.

What shouldn’t the Complaints Process be used for?

Filing a formal complaint under Equity’s Bylaws is not a practical first step for dealing with existing workplace issues. It’s always best to address an issue directly with the engager while in the workplace, as soon as possible. The goal should be to restore a healthy, positive workplace where artists can thrive creatively and professionally.

Equity’s Complaint process does not extend to complaints against non-members. Complaints about non-members should be directed to the Engager.

Submit a Complaint Filing Form

Filing a formal complaint must be done using the Complaint Filing Form. It is important to provide descriptive details regarding the event(s) that form the basis of a complaint, including:

  • When it happened (date)
  • Where it happened
  • Who was involved
  • What happened

Overview of the Formal Complaints Process

  1. A formal complaint is filed using the Complaint Filing Form and submitted to the Equity Complaints Manager.
  2. Formal complaints are given to a Review Panel made up of three Councillors tasked with presenting a recommendation to dismiss the complaint, refer the complaint to a Disciplinary Panel, or offer mediation to the parties named in the complaint. The Review Panel may reach out to the Complainant for clarification to help make their determination.
  3. The Review Panel’s recommendation is presented to Council and Council ultimately decides whether to dismiss the complaint, refer the complaint to a Council Resolution Panel, or offer mediation.
  4. If the formal complaint is referred to a Resolution Panel (made up of Councillors), the Panel will speak with the parties involved, consider the Review Panel’s initial findings, consult witnesses if necessary, and consult with legal, mediation, or other experts, as appropriate. They may also choose to refer the investigation to a third-party investigator.
  5. A decision will be rendered by the Resolution Panel to either dismiss the formal complaint or seek a restorative process that may include a penalty.
  6. All parties involved have the right to pursue an appeal of the Resolution Panel’s determination.
